This privacy policy applies to national and international versions of the Site and national and international Users.
This policy does not apply to information collected by us offline or through other means, including on any other website operated by Eagle Eye, LLC or any third party, including through any application or content that may link to or be accessible from or through the Site.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to (i) not to use the Site or Software; or (ii) opt-out of certain policies as will be described in this policy. Otherwise, by accessing or using the Site or Software, you agree to this privacy policy.
Key Definitions
1. "Eagle Eye", "we", "us", and "our" means Eagle Eye, LLC and its subsidiaries, agents, employees, and representatives.
2. "Personal Data" means any information relating to an identified or identifiable natural person who is a User.
3. For purposes of this Policy, "processing" means collecting, recording, organizing, structuring, storing, adapting, altering, using, disclosing, or otherwise making available, and deleting Personal Data provided to us through the Site or Software.

B. Personal Data We Collect
Users provide Eagle Eye with most of the Personal Data we collect. We collect the following types of data:
- Personal Identification Information You Give Us: We collect Personal Data such as your name, email address, username, password, demographic information (such as your gender and occupation), and other information you directly give us through the Site or Software.
- Information We Get from Others: We may collect information gathered from third-party sites or sources you accessed, such as Stripe, OpenTable, Facebook, Google, or Twitter. Any third-party information may be combined with the information received directly from you. Some third-party sites or sources may also provide us with information from your accounts to enhance and personalize your use of our Site. You have the right to modify your privacy settings on your device, browser, or on the third-party sites and right to refuse to provide certain information or receive interest-based advertisements on those third-party sites directly on the respective third-party site.
- Passive Information Collected: When you visit our Site, we automatically collect usage data and computer operating information such as the operating system type, cookies, web beacons, browser type, browser language, the Site you visited before browsing to our Site, pages you viewed, how long you spent on a page, access times, Internet protocol (IP) address, and other information about your use of and actions on our Site to customize your visit through technical means. The information that we collect automatically may include Personal Data or we may associate it with Personal Data that we collect in other ways or receive from third parties.
- Public Content: You can contribute to the Site in several different ways, including uploading photos, embedding videos, participating in forums, tagging products, filling out your public profile, and voting on other users' contributions. We may store these contributions (your "Public Content"), display them to other users, and use them for promotional purposes. Note that if you include Personal Data in your Public Content, it can be used and viewed by others. We are not responsible for the information you choose to include in your Public Content. Additionally, we cannot control the actions of other Users of the Site with whom you may choose to share your Public Content. Therefore, we cannot and do not guarantee that your Public Content will not be viewed by unauthorized persons or used in unauthorized ways.
- Cookies: Cookies are text files placed on your computer to collect standard Internet log information and visitor behavior information. When you visit our Site, we may collect information from you automatically through cookies or similar technology. Eagle Eye uses the cookies in a range of ways to improve our Users' experience on the website.
- Cookies are small data files containing information which are downloaded to your computer or mobile device when you visit a certain webpage. Cookies enable us to recognize users on our Sites and personalize webpages based on user behavior to improve user experience. Cookies enable users like you to navigate between pages efficiently while remembering your preferences. Through our use of Cookies, we can gauge whether you have visited our Sites before and what searches or content is most relevant to you, custom-tailoring your user experience based on past history. All Cookies are different and therefore all Cookies have different longevity periods. Under no circumstances may you disclose to us the Personal Data of another person, without first obtaining that person's express consent to both the disclosure and the processing of that Personal Data in accordance with this policy.
C. How We Will Use Your Personal Data
Personal Data submitted to us through our Site will be used for the purposes specified in this policy or as provided for on the Site. Eagle Eye collects the Personal Data of Users so that we can:
- Improve customer service: Information you provide helps us respond to your customer service requests and support your needs more efficiently.
- Personalize User experience: Information is used in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
- Improve our Site: Feedback you provide is used to improve our management ideas, products, and services.
- Process order and payment: Information Users provide about themselves when placing an order is used only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
- Run a promotion, contest, survey, or other Site feature: To send Users information they agreed to receive about topics we think will be of interest to them.
- Send periodic emails: We use the email address to send User information and updates pertaining to their continuous improvement tools order. It is also used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product, or service information, etc. A User may unsubscribe from such emails at any time. If the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.
- Other: We may use Personal Data in other ways to fulfill any purpose for which you provide us with the Personal Data, for any other purpose with your consent, or in any other way we may describe when you provide the information, including to carry out our obligations and enforce rights that may arise from any contracts entered between you and us.
Any Personal Data submitted by you for publication on our Site grants us a license to use your Personal Data. You may modify your privacy settings to limit our use of your information on the Site by adjusting the Site privacy controls.
We will not, without your express consent, supply your Personal Data to any third party for their or any other third party's direct marketing. We do not sell, trade, or rent Users Personal Data to others. If you provide consent, we will share information you provide to third party service providers for the sole use of the third-party service providers helping us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys.
Sharing Personal Data
Although Eagle Eye will ordinarily only share your Personal Data pursuant to a User's request or consent, Eagle Eye expressly reserves the right to release any Personal Data pursuant to the following circumstances: (a) when required by law or legal process, (b) to investigate and/or take action against illegal activity, suspected abuse, or unauthorized use of our services, (c) to protect the property or safety of our users or others, (d) to enforce our Terms of Use, and (e) in connection with any sale or other transfer of ownership of all or a part of Eagle Eye, or any of its affiliates.
If you make any Personal Data publicly available on the Site (e.g., by posting a listing which contains Personal Data), anyone may see and use such information and we are not responsible for such use. The Site reserves the right to share any Personal Data you post on the Site with third parties with your prior consent. To the extent the Site does so, the subsequent use and disclosure of such information is subject to the privacy policies and practices of those third parties.
Disclosing Personal Data
We disclose your Personal Data to our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors as reasonably necessary for the purposes set out in this policy and our Terms of Use. We also disclose your Personal Data to any member of our companies (including any of our subsidiaries, holding companies and all its subsidiaries) as reasonably necessary for the purposes set out in this policy and our Terms of Use and Disclaimer.
Choices About Use and Disclosure of Your Personal Data
When you visit or use our Site or Software, you have choices regarding the Personal Data you provide to us.
- Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of this Site or the Software may then be inaccessible or not function properly. You can also opt out of certain cookie settings upon your first visit to the website and make your cookie selection.
- Promotional Offers from the Company. If you do not wish to have your contact information used by us to promote products or services, you can opt-out by utilizing the "unsubscribe" feature at the bottom of our emails or by submitting a written request to opt-out of the emails by sending an email to unsubscribe@eagleeyeapp.ai. If we have already sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to us as a result of a product purchase, Software purchase, or other transactions with us.
D. How We Store and Retain Your Data
Our data retention policies and procedures are designed to ensure that we comply with our legal obligations regarding the retention and deletion of Personal Data in accordance with all applicable state, federal, and international laws and regulations.
Eagle Eye does not keep any Personal Data for longer than is necessary to carry out the purpose or purposes for which the Personal Data was collected. Users may request Eagle Eye to delete their Personal Data or request an accounting of all Personal Data of theirs kept by Eagle Eye by sending an email to dataprotection@eagleeyeapp.ai. Eagle Eye will respond within five (5) business days to any such requests. Notwithstanding the other provisions of this Section D, we will retain documents (including electronic documents) containing Personal Data:
- To the extent that we are required to do so by law;
- If we believe that the documents may be relevant to any ongoing or prospective legal proceedings; and/or
- To establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
E. Security Measures
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and Personal Data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures. You are responsible for keeping the password you use for accessing our Site and Software confidential.
You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
If a data breach occurs: If we determine that any User's Personal Data has been accessed without authorization, Eagle Eye will report any confirmed or suspected situation to necessary parties immediately upon discovery, both orally and in writing, within 72 hours. If Eagle Eye reasonably believes a breach has or may have occurred, Eagle Eye will release a report to all Users identifying:
- The nature of the unauthorized access, use, or disclosure;
- The nonpublic information accessed, used or disclosed;
- The person(s) who accessed, used, disclosed, and/or received nonpublic information (if known);
- What Eagle Eye has done or will do to mitigate any deleterious effect of the unauthorized access, use, or disclosure; and
- What corrective action Eagle Eye has taken or will take to prevent future unauthorized access, use, or disclosure.
In the event of a suspected Breach, Eagle Eye will keep stakeholders informed regularly of the progress of its investigation until the uncertainty is resolved. To the extent possible, we will also facilitate the process to warn the victims of the theft so that they can protect their identity.
F. International Data Transfers
The Site is hosted in the United States, and all or a portion of the Site may also be hosted on the "cloud", or other similar distributed hosting platform. If you are accessing the Site or Software from the European Union, Asia, or any other region with laws governing Personal Data collection, use, and disclosure that differ from United States laws, note that you are transferring your Personal Data to a jurisdiction that does not have the same data protection laws as your home jurisdiction. By providing your Personal Data you consent to:
- our use of your Personal Data for the uses identified in this Privacy Policy, and
- the transfer of your Personal Data to the United States.
Under the General Data Protection Regulation (GDPR), if you have provided consent for the processing of your Personal Data, you have the right to withdraw consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn. You have the right to request access to and rectification or erasure of your personal information, as well as the right to restrict processing, object to processing, and under certain circumstances the right to data portability. Eagle Eye will be completely transparent in how we use Personal Data and Users have the right to know exactly what information is held about them and how it is processed.
California Residents
If you are a California resident, California Civil Code Section 1798.83 permits you to request free of charge information regarding the disclosure of your personal information by us to third parties for the third parties' direct marketing purposes. To make such a request, send an email to dataprotection@eagleeyeapp.ai. Eagle Eye will not share Personal Data with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your Personal Data to third parties for their direct marketing purposes by withholding consent.
G. Personal Data Rights for Certain Users
There are state and international laws which provide their residents and citizens with additional rights regarding our use of their Personal Data. This section is to discuss those rights and your options to exercise such rights if they apply to you.
Users in the European Union, California, Colorado, Connecticut, Virginia, Florida, Montana, Oregon, Kentucky, New Jersey, Nebraska, New Hampshire, Tennessee, Iowa, and Utah each are provided with the general rights to:
- Right to Access: Right to request Eagle Eye for copies of their Personal Data. Eagle Eye may charge you a small fee for this service. For Users residing in California, this right also includes the ability to request all Personal Data Eagle Eye has obtained relating to the User in the 12 months prior to the request and to have information on who the information was shared with and how it was shared, if at all.
- Right to Rectification: Right to request that Eagle Eye correct any information in our possession or control which they believe is inaccurate. This also includes the right to request that Eagle Eye complete any information in our possession or control which they believe is incomplete.
- Right to Erasure: Right to request that Eagle Eye erase their Personal Data, under certain conditions.
- Right to Restrict or Object to Processing: Right to request that Eagle Eye restrict and/or object to the processing of their Personal Data for targeted advertising and sales, under certain conditions.
- Right to Object to Profiling: Right to opt-out of any profiling through the processing of Personal Data being performed and to opt-out of any profiling being shared or sold to third parties.
- Right to Data Portability: Users in the European Union (or locations where the General Data Protection Regulation is enforced) have the right to request that Eagle Eye transfer their Personal Data to another organization or directly to the particular European User, under certain conditions.
To make a request to exercise any of the above rights, the User must submit the request in writing to dataprotection@eagleeyeapp.ai. While we aim to provide prompt responses to all requests, Eagle Eye will respond within forty-five (45) days from the initial request.
If you think that the processing of your Personal Data is not in compliance with data protection laws, you have the right to make a complaint about Eagle Eye to the appropriate authorities. We encourage you to contact us at dataprotection@eagleeyeapp.ai before raising a concern with the supervising authority, to see if we can resolve any concerns you have about our processing of your Personal Data.
H. Children's Online Privacy Protection
Protecting the privacy of children is especially important to us. We may collect information of minors under the age of 13 with parental or guardian consent. Information of minors that is collected, processed, and stored may include name, birth date, address, email address, and phone number. The personal information will be used to provide services to the minor, improve customer service, and personalize the minor's experience with our services and Software. Personal information of minors will not be disclosed to third parties.
Notice to Parents/Guardians
If we learn we have collected or received information from a child under the age of 13, without verification of parental or guardian consent, we will delete that information immediately upon discovery. If you believe you may have provided information from or about a child under the age of 13 without parental or guardian consent, please notify us in writing to dataprotection@eagleeyeapp.ai. Before collecting any personal information from children under 13, we require verifiable parental consent, which may be obtained through:
- An email verification process or a form that parents complete and sign.
- Confirmation of consent through additional methods as necessary.
I. Third-Party Services
Our Site may contain links to third-party websites or services, such as third-party integrations, co-branded services, or third party-branded services ("Third-Party Services"). Eagle Eye doesn't own or control these Third-Party Services. Through your interaction with such Third-Party Services, you may be providing information directly to the Third-Party Service, Eagle Eye, or both. These Third-Party Services are required to have their own privacy and data collection policies. We encourage you to review those privacy policies.
While we encourage our business partners to adopt privacy policies and practices that build Users' trust and confidence in the Internet, we are not responsible for the privacy policies or practices of third parties or any of the content of websites linked to the Site or any third-party products or services offered through the Site.
J. AI Tools
Eagle Eye may utilize AI tools to operate, optimize and improve the Software, our Site, or our services, and to provide you with new product features. The use of AI tools may include the use of speech recognition, audio conversion to text, text generation, text summarization, translation, question answering, sentiment analysis, text classification, information extraction, and other generative AI solutions. It may also include, but is not limited to, the use of computer vision including image classification, object recognition and detection, facial recognition, image segmentation, pose estimation, optical character recognition, motion analysis, and anomaly detection.
Personal data may be processed in this context. This applies in particular to data that you provide to us or that you input when using the AI tools. This data is processed in order to train our AI, to generate content, to provide services to you and to further develop and optimize our services. We also reserve the right to analyze the usage data for quality assurance purposes.
If you use AI-supported services such as chatbots, the use of AI and the associated data processing is generally based on the legal basis of contract fulfillment. Data processing for other purposes, in particular for training purposes, is based on consent or, if we do not obtain consent, on the basis of our legitimate interest in optimizing our services.
K. Changes to Our Privacy Policy
Eagle Eye keeps its privacy policy under regular review and places updates on this web page. We reserve the right to update this Privacy Policy from time to time by publishing a new version directly to the Site. We may notify you of any such changes by email or by posting a notification on the Site's home page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.
